Read this and make a copy for your files in case you need to refer to it someday. Maybe we should all take some of his advice! A corporate attorney sent the following out to the employees in his company:

    1. Do not sign the back of your credit cards. Instead, put ‘PHOTO ID REQUIRED.’

    2. When you are writing checks to pay on your credit card accounts, DO NOT put the complete account number on the ‘For’ line. Instead, just put the last four numbers. The credit card companyknows the rest of the number, and anyone who might be handling your check as it passes through all the check processing channels won’t have access to it.

    3. Put your work phone # on your checks instead of your home phone. If you have a PO Box use that instead of your home address. If you do not have a PO Box, use your work address. Never have your SS# printed on your checks. (DUH!) You can add it if it is necessary. But if you have It printed, anyone can get it.

    4. Place the contents of your wallet on a photocopy machine. Do both sides of each license, credit card, etc. You will know what you had in your wallet and all of the account numbers and phone numbers to call and cancel…… Keep the photocopy in a safe place. I also carry a photocopy of my passport when I travel either here or abroad. We’ve all heard horror stories about fraud that’s committed on us in stealing a Name, address, Social Security number, credit cards.

But here’s some critical information to limit the damage in case this happens to you or someone you know:

    5. We have been told we should cancel our credit cards immediately. But the key is having the toll free numbers and your card numbers handy so you know whom to call. Keep those where you can find them.

    6. File a police report immediately in the jurisdiction where your credit cards, etc., were stolen. This proves to credit providers you were diligent, and this is a first step towardan investigation (if there ever is one).

But here’s what is perhaps most important of all: (I never even thought to do this.)

    7. Call the 3 national credit reporting organizations immediately to place a fraud alert on your name and also call the Social Security fraudline number. I had never heard of doing that until advised by a bank that called to tell me an application for credit was made over the internet in my name.

The alert means any company that checks your credit knows your information was stolen, and they have to contact you by phone toauthorize new credit.

Now, here are the numbers you always need to contact about your wallet, if it has been stolen:

    • 1) Equifax: 1-800-525-6285 1-800-525-6285
    • 2) Experian(formerly TRW): 1-888-397-3742 1-888-397-3742
    • 3) Trans Union: 1-800-680 7289 1-800-680 7289
    • 4) Social Security Administration(fraud line): 1-800-269-0271 1-800-269-0271

Personal injury lawyers, often called plaintiffs’ are those lawyers who represent people who are injured in accidents (such as Sacramento semi truck accidents) or suffer personal injuries caused by others. On the other side of the table are personal injuries caused by others. On the other side of the table are defense lawyers, hired to represent tortfeasors—the people who cause accidents. Many people assume that the term “defense lawyer” refers to a lawyer who represents criminals; typically, however, these are specifically called “criminal defense lawyers.”

The lawyers that we usually refer to as “defense lawyers” represent civil defendants, the people being sued in civil lawsuits (noncriminal), such as the at-fault driver (tortfeasor) in a car accident.

If you have ever looked in the lawyers/attorneys section of the yellow pages, you will note that there are often many lawyers with full-page advertisements. There are photos of accident scenes, ambulances or other fancy ads trying to draw you in with catchy slogans about “trust” and “getting money for you.” These are the ads for personal injury lawyers. You will also often see ads for those same lawyers on billboards, on television, on the radio, plastered on buses and taxicabs and wherever else they think might get your attention.

You will rarely see large or flashy ads for defense lawyers. In fact, you may never see any ads at all for defense lawyers, as they are usually hired by insurance companies and other corporations and therefore do not need to advertise very much, if at all, to the public.

So You’ve Been in an Accident…

Another difference between defense lawyers and plaintiffs’ lawyers is that more often than not, defense firms are larger than plaintiff firms. There are many defense firms in the U.S. with 500 or more lawyers and multiple offices throughout the country and even internationally. For example, the Chicago based firm Baker & McKenzie has over 3,000 lawyers located in offices throughout the world.

By contrast, in many places, a plaintiff firm with 10 lawyers is considered large. The majority of plaintiff firms are, in fact, solo practitioners—firms with only one lawyer.

One of the reasons that legal fees charged by plaintiffs’ lawyers tend to seem somewhat high results from the tremendous amount of money that is spent on advertising, especially in the yellow pages. It is not unusual for even a small plaintiffs’ law firm to spend many hundreds or even thousands of dollars per month on yellow pages advertising alone. This is in addition to costs for billboards, radio spots and television commercials. The fact is that many of your legal fee dollars go straight to the phone company and other advertising outlets.

You may find that your lawyer and the defendant’s lawyer often argue very strongly with each other about various issues in your case. Your lawyer might even say disparaging things to you about the behavior of the other lawyer. If you happen to go to court when your lawyer is arguing an issue with the judge, it might appear as though they might attack each other at any moment. What might surprise you is that often you will see your lawyer fight with the defendant’s lawyer like gladiators over legal issues, but then catch them discussing where they are going for dinner or drinks later on.

Lawyers are trained to argue strongly in defense of their clients’ positions. To do this well, lawyers must learn not to take the things said by the other lawyers personally. Often lawyers on opposite sides of a case are close friends. So even though they appear to be enemies in the courtroom, do not be surprised if they are very friendly afterward.

On average, drivers of large trucks travel many more miles than passenger vehicle drivers. In 2007, large trucks accounted for 4 percent of registered vehicles and 7 percent of miles traveled. Per unit of travel, large trucks are involved in more fatal crashes than passenger vehicles – 1.9 compared with 1.6 crashes per 100 million miles traveled in 2007. The disparities between large trucks and passenger vehicles vary by specific vehicle type, with cars having the lowest fatal crash rate (1.3) and tractor-trailers having the highest rate. The higher fatal crash rate for large trucks occurs although much higher proportions of their miles are traveled on interstate highways, which are the safest roads. The higher fatal crash rate is attributable to the size disparity between large trucks and passenger vehicles. Large trucks have a much lower rate per mile traveled of nonfatal crashes resulting in injuries or property damage only compared with passenger cars and light trucks.

About 5,000 people die each year in crashes involving large trucks, and 84 percent of them are not truck occupants. In fatal two-vehicle crashes involving a passenger vehicle and a large truck, 98 percent of the deaths occur to the occupants in the passenger vehicles. Large trucks accounted for 4 percent of registered vehicles and 7 percent of vehicle miles traveled in 2007 but were involved in 11 percent of all motor vehicle crash deaths and 23 percent of passenger vehicle occupant deaths in multiple-vehicle crashes.

A tort is a civil wrong that is not based upon a contract. If, for example, a person runs a red light and strikes your vehicle (which is lawfully in the intersection), then you could sue that person civilly for the tort of having run the red light. That tort action does not arise out of any contract between you and the other person.

    Motor Vehicle Accidents

The most common form of tort claim arises from automobile collisions. Those tort claims normally involve some careless or reckless act by one driver resulting in a collision with another motor vehicle. Whether the operation of a motor vehicle involves actual negligence depends upon how the drive’s conduct is viewed in the light of the Rules of the Road as set forth either in your state code or local code governing traffic regulations. The rules of the road or traffic regulations establish the standards for operation of motor vehicles. A violation of these rules or regulations typically constitutes negligence.

Motor vehicle accidents involving common carriers (buses, taxis, trains, and planes) may have a set of rules that are slightly different than what would apply to an automobile. Common carriers are frequently held to a very high degree of care. As such, if there is even slight negligence on their part that contributes to the injury of one of their passengers, then the common carrier may be liable.

Thousands of people are injured and killed each year in the United States after being involved in truck accidents on the streets and highways. Recent statistics have shown that every sixteen minutes in the U.S. a person suffers an injury or fatality due to a truck accident.

Some factors that cause big rig and large truck accidents throughout California and the entire United States include fatigued drivers, dangerous operation of the vehicle, and excessive amounts of cargo.

With big rigs weighing in at 80,000 pounds, any other type of motor vehicle is no match for a large truck. The repercussions of an accident involving a big rig can be devastating, possibly resulting in fractured bones, brain and head injuries, paralysis, back and neck injuries, spinal cord injuries or death.

If you have been injured in a trucking accident, our California attorneys will fight to make sure you are fully compensated for your losses.
